Skiljenämnden överskred sitt uppdrag men skiljedomen står ändå fast

Den 8 maj 2024 meddelade Hovrätten för Västra Sverige dom i mål nr
T 2710–22 där det konstaterades att en skiljenämnd hade överskridit sitt uppdrag genom att grunda skiljedomen på omständigheter som inte hade åberopats av den part som hade åberopsbördan. Hovrätten upphävde inte skiljedomen trots detta eftersom skiljedomen även grundats på åberopade omständigheter.
